However, one legal relationship that is of fundamental importance in our society, but which often goes overlooked, is that of landlord and tenant. Landlord and tenant enter a complex legal relationship defined by the instrument of the lease, and the proper upholding of this instrument has significant repercussions for both landlord and tenant alike. The landlord clearly has profits and financial interests invested in the leasing of property, whereas for the tenant, it is often the case that his or her home and fundamental security are at stake. For this reason, it is critically important to ensure some degree of balance of power in the landlord and tenant relationship. Neither side must be able to exert undue power over the other, and there must also be clear avenues of recourse by which each party may redress its grievances and protect its rights. With this in mind, most governments around the world have adopted entire subsets of law known as Landlord Tenant Law, which governs the nature of the relationship, and what can be done to preserve its integrity. A key example of just such a piece of legislation is the Landlord and Tenant Act of 1985, a series of laws drafted in the United Kingdom to ensure balance in the landlord and tenant relationship. This paper will explore one particular section of the Act, Section 11, as it pertains to the responsibilities of the landlord to provide repair services to any property he or she is leasing, at no cost or consequence to the renter.
