part of the legal landscape in America. But today, with lawsuits flying from every corner, some believe that certain things should be kept private, particularly if it is damaging to
ones reputation or psyche. For example, some rape victims have a hard time coping with the violation, and as a result, do not even report the crime. Some critics therefore
believe that allowing a rape victims name to be kept confidential would be prudent. It would be helpful to the rape victim and may be thought of as encouraging, allowing
for more women to come forward. In the central park jogger case, the victim was allowed to remain anonymous and years later, she came forward herself with the publication
of a book. Hence, the victim had time to assimilate the ordeal, let it sit, and later come out and provide details of the crime. That perhaps brought her some
closure and satisfied the publics right to know, and the facts came about in its own time. But such a situation is a rarity today. Carl Bernstein asks: "Is there
any escape from the lurid and the loopy of tabloid TV?" He goes on to discuss the fact that when William Smith was on trial, the New York Times did
unfortunately release the rape victims nameii. Here, it is implied that the paper did so as it was supporting a Kennedy family member and also, simply for "ratings." In this
