Disabilities Education Act (IDEA) provides the basis of legally-protected parental rights the education of their children. IDEA ensures that a free, appropriate education (FAPE) is available for all children regardless of ability and requires that educators and the local school devise an individual education plan for each special education child. IDEA requires educators to include parents in planning the IEP if the parent wants to participate (the parent has the right to be involved but is not required to be), and it also provides a means for parents to question at any time the appropriateness of his childs IEP or the apparent progress his child is making in school. IDEA also requires that each childs IEP be reviewed and revised at least once a year, or at any time that the parent requests such a review. Disputes can arise at any point in this process. The Need for Dispute Resolution Because disputes can arise at any time, school systems need to have in place a means for dealing with those disputes. Disputes can be costly for local school systems, particularly if parents file suit against the school or the school district. One retired elementary principal in Tennessee often spoke of a particularly troublesome parent who requested IEP review no less than once a month. The fifth-grade student was severely physically and learning disabled, to the point that the school was required to furnish a fulltime care provider for the school day. The students progress in learning was painfully slow, and the parent demanded an IEP review every month of the school year.
