Privacy and Confidentiality In 1890, Warren and Brandeis described the way in which the law has evolved over the years, and wrote in part: "Recent inventions and business methods call attention to the next step which must be taken for the protection of the person, and for securing to the individual what Judge Cooley calls the right to be let alone" (Warren and Brandeis, 1890). The right to privacy means that an individual is free from unwanted and unwarranted intrusion in to his personal matters. More broadly, "privacy can be thought of as describing conditions of limited accessibility to various aspects of an individual-both physical and informational" (Privacy and confidentiality, 2005). Privacy can be defined as "the capacity to be physically alone (solitude), to be free from physical interference, threat or unwanted touching (assault, battery); or to avoid being seen or overheard in particular contexts" (Privacy and confidentiality, 2005). It also refers to a persons right to control how, when, where and to what degree he gives information about himself to others (Privacy and confidentiality, 2005). Confidentiality is "closely related to privacy, but not identical. It refers to the obligations of individuals and institutions to use information under their control appropriately once it has been disclosed to them (Privacy and confidentiality, 2005). Thus, we can say that confidentiality is the duty of people in control of sensitive information about others to use that information discreetly and professionally so as to protect the privacy of the individual concerned.
