Police Encounters with Suspects and Evidence Research Compiled By - March, 2011 The following examination of constitutional law and police procedure examines a specific case scenario in order to discuss specific aspects of the law and the ramifications of these laws on police procedures. Stated briefly, the facts of the case are as follows: Officer Smith stopped a car because it appeared to have a broken taillight. Because the description of the car matched with one that was involved in the killing of a police officer, he approached with caution and patted down the driver for weapons. When the driver reentered the car, she sped off, engaging the officer in a high- speed chase that ended when her vehicle hit a telephone pole. Smith pulled the driver from the car because he feared an explosion. When he reentered the vehicle, he retrieved a gun from the popped-open glove compartment, and while going through the drivers purse to find identification, he found marijuana. The taillight, while covered with tape, was not broken. Was there reasonable suspicion for the initial stop: In both Terry v. Ohio (1968) and Adams v. Williams (1972), the Supreme Courts ruling indicates that a traffic stop is constitutionally justified as long as there is reason to believe that the individual has committed a crime (Emanuel, 2009). This means that the officer must have "reasonable suspicion, based on objective facts" (Emanuel, 2009, p. 124).
