Parish and the defendant Pani Smyrnos were involved in a hearing that took place in September of 2002 for which judgment was passed in October of 2002 ("Parish v Smyrnos," 2003). The plaintiff brought the appeal because he himself was previously convicted on a stalking charge and was concerned about how it would reflect on his character and reputation (2003). This is quite an interesting case in that the current plaintiff had been convicted and acted criminally, but takes issue with the original plaintiff because he is concerned about the original charge--for which he was found guilty--and how it would affect his career. The plaintiff is a young man and the facts of the case are rather odd. Due to circumstances that rendered him temporarily lonely, depressed, moody and so forth, he decided to write a letter to an elderly woman ("Parish v Smyrnos," 2003). It was a rather amorous and perhaps threatening letter. Certainly, it was adolescent behavior at its worst, and probably the plaintiff meant nothing by it other than to satisfy his own boredom, but the woman took the letter seriously. It was at the same time that she received this letter, after having heard a door bell ring at an early hour, that she looked outside and saw a naked man with an erect penis (2003). She was frightened. This case involves an appeal, and whether or not the defendant should be given new consideration. At issue is the stalking law. The case goes on to review definitions of the stalking law and defines it as follows: " following the victim or any other person; telephoning....entering or loitering outside or near the victims or any other persons place of residence or of business or any other place frequented by the victim or the ...
