This 36 page paper examines the links between mental illness and crime and how this is dealt with in the UK criminal justice system. The paper starts by defining mental illness, looking at general definition and then at the legal definition used in the UK. The paper then considers what types of illness are classified as mental illness and the links between drugs, alcohol and crime. The way a crime is deemed to be committed is examined with the concepts of mens rea and actus reus and how the law is applied, including the use of an insanity defence. crime. Surveys vary on the level of mental health patient in prisons or in remand vary. Estimates indicate that up to 90% of the in prisons will suffer from some
sort of mental illness or a substance abuse problem (PRT, 2005; 4). The level of prevalence is up to 20 times that of the general population (PRT, 2005; 4).
However, not all those who are mentally ill will end up in prison or in the criminal justice system and not all types of mental illness will be proportionality represented
in those who come into contact with the criminal justice system. However, those with a mental illness may also be seen some of the more vulnerable members of society, and
like any other vulnerable member of society, they need to receive appropriate treatment and care. At the same time, the role of the criminal justice system has to protect society
and seek to gain a balance between the required protection for each group. In order to develop appropriate strategies that minimise the impact on society but also allow for
care and treatment of those with mental illness there need to understand what the current link is and how those with mental illness will be treated once they get into
