However, there are also those who argue that even if DNA testing is reliable the other forms of evidence that go along with a case that utilizes DNA testing is not as reliable. In essence, court cases are not something that rely on solid facts that are undeniable, no matter how solid the evidence. The following paper examines the issue of controversial evidence in various cases and situations. Controversial Evidence In a first look at the concern of controversial evidence one author quotes another who states, "The premise is interesting that scientific evidence is more reliable than other evidence. . . . It would be nice if it were true...In the cases of wrongful conviction that we know about, scientific evidence is a very significant factor" (Daley, 2004). Such information suggests that all evidence, even scientific evidence, could well be considered controversial in many respects due to the fact that even with scientific evidence innocent people have often been convicted of crimes they did not commit. The author notes that one particular individuals plan, which would address first-degree murders that involving torture or the killing of a law enforcement officer, is a plan that does not require scientific proof (Daley, 2004). "Rather, it would require a jury to find evidence reaching a high level of scientific certainty that will strongly corroborate the defendants guilt" (Daley, 2004). Again, this seems to suggest that no matter the evidence, room for error and thus controversial evidence, is still in play to a large extent.
