to many constitutions, but in the case of the United States it normally applies to the notion of safeguarding democracy and the rights of the people as they relate to the foundations set in the constitution itself. However, the truth is that nothing is perfect and as such Constitutions do not always guarantee or safeguard democracy or rights. The following paper examines this reality. Constitutional Guarantees In relationship to democracy, one author interestingly notes that, "Democracy is indeed a set of ideas and principles about freedom, but it also consists of a set of practices and procedures that have been molded through a long, often tortuous history."2 In addition, democracy is constantly undergoing change and as such is not always safeguarded. This is likely evident when looking at the United States, and other nations which surprisingly also offer a constitution that supposedly safeguards democracy. For example, the United States is considered a democracy but one must also understand that a democracy is generally a society that is ultimately governed by the majority. This would indicate that there are likely some rights, of some peoples, that are not safeguarded in the democracy that involves the majority rule. Other nations which are considered incredibly different, and which further illustrate the complexity of constitutions and safeguarding democracy, include "Canada and Costa Rica, France and Botswana, Japan and India."3 As it involves the United States specifically, the Constitution has divided the government, the federal government, into three different branches in order to best safeguard rights.
