History of the Case The case was heard before the Supreme Court of the State of Montana; it was an Original Proceeding from the District Court of the Thirteenth Judicial District, In and for the County of Yellowstone. On January 8, 1999, "the District Court for the Thirteenth Judicial District, Yellowstone County, issued an Order denying Bonnie Kuntzs motion to dismiss or strike an amended information" (State v. Kuntz, 2000). The information that Kuntz sought to have dismissed was in regard to her failure to render assistance to Warren Becker, whom she had stabbed (State v. Kuntz, 2000). Kuntz stated that she stabbed Becker in self-defense, and that her use of force in self-defense nullified any duty to render aid to the victim, and that because of this, information relating to her failure to summon help should be stricken or amended. 5. Facts of the Case On April 19, 1998, Bonnie Kuntz allegedly stabbed Warren Becker in the home they shared. They had been together for six years but were not married and their relationship was described as "stormy" (State v. Kuntz, 2000). When the Yellowstone County Sheriffs deputies arrived at the scene, Becker was dead, having sustained a single stab wound to the chest (State v. Kuntz, 2000). Kuntz stated that she and Becker had argued earlier that day, and both had left the trailer home; when Kuntz returned at about midnight, she found that the trailer was a mess and Becker had destroyed many of her personal belongings (State v.
