All considerations of whether or not the Gamamahi is actually unsafe aside, as this is an issue for others to resolve, it is imperative that we develop a full understanding of the legal aspects of the case as they have unfolded, for the purpose of cultivating a sound counterstrategy for dealing with issues of liability and defending our rights in the context of the CPSC and its charter document, the Consumer Protection Safety Act. With this in mind, we should conduct a brief overview of the facts of the case. Apparently a number of consumers who had purchase the Gamamahi toy sent complaints to the CPSC stating that the toy would overheat when left on for long periods of time, in at least one case causing severe injury and property damage due to the unit catching on fire. After receiving a number of these complaints, the CPSC issued Kids Toys a Notice of Investigation and Inspection, that did not contain a set time. Agents from the organization turned up unannounced and conducted a surprise inspection of the Kids Toys, Inc. facilities, to which the company relented. Employees were interviewed about all stages of the manufacturing process, from production to distribution, and copied a number of internal documents. Among those documents were a few letters of complaints that Kids Toys, Inc. itself had received, attesting that the Gamamahi units had overheated. At once, the CPSC extended its actions to include an agency adjudicatory process on the grounds that Kids Toys must have known about the danger, but did not report this voluntarily to the CPSC, as is required by law.
