The basis of this policy is that software piracy is illegal and extremely costly. In 2001, The Metropolitan Education District in San Jose, California paid out $50,000 to settle a case brought by the Business Software Alliance (BSA). The BSA represents large U.S. software manufacturers and acts as a watchdog in identifying software licensing fraud. After an audit of the school district, similar to the audits performed at this institution, the BSA found the Metropolitan Education District in violation of using unlicensed copies of Adobe, Macromedia and Microsoft software programs. In other words, the district had several legal copies of these programs, but they were copied onto numerous computers. This is illegal for these products. The software license agreements specifically state that only one copy can be in use by one user at one time. The contracts do not allow for multiple users over multiple systems. As this indicates, it is illegal to have any unlicensed software applications on your computer as both employees and students of this institution. Though it may be legal to have multiple copies of Open Source software, or freeware/shareware on your system, depending on the related software licensing agreement, you will be held personally, financially and legally accountable for any costs associated with harboring pirated, distributing or unlicensed copies of any software application or any other violation of a software license agreement of any software application found on any school computer.
