The idea of the law being used as a toll then raising some interesting questions in the way it can and should be used. The law may be seen as a way of enforcing a moral code or values for society. This is how Lord Devlin (1965) saw the law. However, it was seen as merely a tool, the original of the moral code it was enforcing was not in the law but in the law makers and as such it was a tool that should reflect the views of the populace and as such the manipulation is of the minatory. For Hart (1994) it was the law was based on duty and moral were seen as personal, here Hart sees the law as more universal and as a way of enforcing values that even the majority may not hold, as it is a guiding tool, pointing the way to what should be, rather than a reflective tool, reflecting opinion. The way the law is seen to operate to enforce these with a duel purpose, but different commentators will emphasis different aspects of the way the law works. The law may be seen as having a deterrent effect. If people know that a specific act is against the law then the prospect of punishment may be enough to deter undesired behaviour.
