similar processes and considerations in all cases. In this paper we can consider the way that doing business with the US may be considered, a country with a very legal
system, but one that may be attractive due to it size. The report will consider different issues that may be assessed. 2. Which Laws will Govern the Contract? When contracts
are formulated and agreed there is, but the very nature of a contract, an intention to create legal relations (Card and James, 2007). The contracting parties in a commercial environment
will usually be assumed to be equals, and in the way that the contracts are negotiated there will be the negotiation of terms and condition, in many cases these may
be standard terms and condition that have been formulated. However, even in the most comprehensive contract there will not be the ability to develop terms for every scenario, as such
it is common for a term to be included stating which countrys laws will be applied to the contract, each firm will usually seek to have their own country as
the legal frame of references. The inclusion of a term such as this in a contract will be persuasive, but it is not automatically enforceable is the issue of
jurisdiction. Jurisdiction can be defined as "The authority which a court has to decide matters that are litigated before it or to take cognisance of matters presented in a formal
