2002). They were on routine patrol, the night beat. Frank and his partner, Gary Malone, received a call in regards to a possible break and entry at a
local supermarket in the high crime district. Taking the call, Frank and Gary arrived at the scene in approximately ten minutes. In front of the store, the scene had escalated.
The officers approached cautiously as there were a large number of people that had gathered in a loose circle around the entrance to the building. Hands on their guns they
radioed that they had arrived and were responding to the call. As they approached Frank could see that most of the group were minorities, which wasnt unusual for the
neighborhood. The cause for the excitement was that the stores owner was holding a large caliber pistol on a young woman who was lying prostrate on the sidewalk in front
of the store. Frank urged the stores owner to lower the gun, which he did, and Gary helped the woman to her feet. Each officer attempted to gain the full
scope of the story, but the noise of the crowd was too great. Gary indicated that he was going to take the woman to the police cruiser so that he
could hear her better. From all indications the woman was under the influence of some narcotic substance as her gaze was fixed, her language was slurred, and she had a
general disheveled appearance. Minutes later, Frank heard a shot ring out as his partner radioed him for backup. The woman had bitten him and was fleeing the scene. Frank
ran to his partners aid and saw Gary turning the corner of the building with his gun drawn. The woman had jumped into what they assumed was her vehicle and
