rule based on the law, but largely based on precedents (Easterly, 2006). This is largely how law is administrated in the United States. The nations that rely on civil law
today are most of the nations on the European continent, while those that use common law are rooted in the British tradition such as the United States ("Do all countries
have civil law," 2009). There are vast differences in these nations as it respects law and order, and how criminals are treated. The civil law countries provide different treatment for
citizens under their legal codes. For example, when someone commits a crime, they are not always entitled to a jury trial. In common law countries, people are allowed trials and
representation by attorneys where the judge sits as sort of a referee, but on the European continent, trials are largely about shuffling paper (Friedman, 1994). Judges are the ones, under
the civil law system, who investigate matters (Friedman, 1994). Also, the jury system is equated with common law (Friedman, 1994). Hence, it seems as if the major difference between the
nations of Europe, with the exception of Great Britain that is entrenched in the common law, and the United States, is that the people are given different degrees of influence.
In civil law nations, people do not have the same rights as they do in common law counties. Although it may be true that systems are different in civil
