The basis in consumer protection law has gradually developed over the years as legal concerns have expanded as well. The point at which implied warranty protection came into existence was when courts began to realize how consumers were belatedly or never being advised of the vague assurance of quality associated with used automobiles, which were cleverly - if not intentionally - placed elsewhere than on the car, and unsuspecting buyers did not know to ask. Clark & Smiths treatise on The Law of Product Warranties sums up the problem by stating how the disclaimer may be found anywhere other than on the product itself, not the least of which includes sales literature (typically sent after purchase), operators manual or embedded within the product packaging but nowhere to be found on the outside prior to purchase.
