provide overnight boarding (i.e. innkeepers, hotels, and motels) and/or food and drink (i.e. restaurants and clubs) have to meet up to certain responsibilities in regards to their guests health, safety, and welfare. In Page v. Sloan. (281N.C. 697, 190 S.E. 2d. 189 (1972)) we find a case where a guest brought litigation against an innkeeper because they thought that the innkeeper had not met up to those responsibilities. This litigation was based on the premises of tort law. The term "tort" is derived from Latin and means "twisted". This is an interesting way of terming an action which deviates from the norm, an act of irresponsibility which causes injury to person or property. As we will seek in an analysis of this case, tort liability is often predicated on knowledge. Following are the answers to seven specific questions regarding this case. 1. What happened to the guest who brought litigation against the innkeeper? In Page v. Sloan the plaintiffs testate lost their life in an explosion due to faulty work by an independent contractor. 2. What duty of care(s) is the court applying? In Page v. Sloan the Court stated that an innkeeper is required to exercise "due care". The Court clarified that this duty of care extended not just to the innkeepers responsibility to keep his establishment in "a reasonably safe condition" but also to the responsibility to "warn his guest of any hidden peril" (Sherry, 1993, pg. 470). ...
