Labor indicates that early in the history of the FLSA, it became apparent that the imposition of minimum wage would have negative effects on some economies in Puerto Rico and the Virgin Islands. Therefore, one of the first amendment to the law addressed this issue. Subsequent amendments to the FLSA have broadened the laws coverage, while raising the level the minimum wage. A chart available on the WHD website indicates that the law when it was first enacted on October 24, 1938 established the minimum wage at 25 cents per hour. Throughout the 1940s and 50s, the minimum wage rose slowly, but did not reach $1.00 per hour until March 1, 1956. Amendments enacted in 1961 extended the scope of the FLSA in regards to retail trade, increasing the minimum from $1.15 per hour in 1961 to $1.25 per hour in September of 1963. The FLSA allowed retail establishments, such as stores and restaurants, to employ fulltime students at wages that were 15 percent below the minimum wage. The philosophy behind this policy was that the monetary compensation that these employees received would also include tips. The history of the minimum wage since its inception in 1938 shows that it has undergone incremental, regular increases, which culminate in the current minimum wage of $7.25, which became effective on July 24, 2009 (WHD, 2011). This history is also characterized by the fact that the law has allowed exemptions and modified the law to fit with special circumstances. For example, the 1996 amendments revised the tip credit provision, indicating that employers were mandated to pay "qualified tipped employees no less than $2.13 per hour," as long as they received the remainder of the required minimum wage in tips (WHD, 2011).
