One of the more prominent of those rights is equality. Despite the fact that equality was a primary focus of our founding fathers, equality has never truly been achieved in our country. The harsh reality is that certain racial, ethnic, and cultural groups in American society have been considered everything but equals. Perhaps even more disturbing, however, given that it affects so many more people, is gender discrimination. Gender discrimination is a blight on our society yet it seems to fester along regardless of what we attempt to do to stop it. Gender discrimination in any form, of course, is prohibited by law. Title VII of the Civil Rights Act of 1964, for example, specifically prohibits discrimination on the basis of sex as well as other criteria like race and national origin1. It mandates equality in the workplace. The Civil Rights Act of 1964 was drafted in a turbulent time in American history, a time where the precept of equality was being tested on more than one front. The civil rights movement was underway and the societal backlash against unfair treatment was becoming prominent. As a consequence, one court case after another was being tried. The outcome of these cases resulted in a continuing evolution in the way gender equality was considered not just in the courts but in society in general. Title VII of the Civil Rights Act is specifically applicable to a number of gender related issues.
