Currently, the United States ranks lowest as far as providing legislation protecting workers jobs, and if that were not shocking enough, consider that many of the State and Federal government differ in their applications of the laws that do exist. In many instances, state laws are stricter and offer more to their citizens than does the federal government. Employment protection refers to regulations concerning both hiring, such as temporary workers or short term contractual workers, and firing, which includes when someone may be laid off and how long the notification periods must be(Employment at will 2004). For example, in 2001 a new law was passed stating that a persons sexual orientation could not be grounds for dismissal in any company whose employee base was more than fifteen employees. Up until that time more than thirty-five of the fifty states in the US allowed sexual orientation as grounds for dismissal(Employment at Will 2004). In this case, then, employee protection was extended to the employee on both a federal and state level. However, there are gray areas and these areas are what concern lawmakers and taxpayers alike. Problems with the employment laws As opposed to other countries and their employment protection laws and policies, it seems that the United States stands out for leaving an unusually large scope to market forces in setting employment conditions. What this means, in translation, is that women, young people, and lesser skilled individuals may find it easier to obtain work, but in the end, the types of work that they are finding do not come with any sort of job security.
