are facing today in regard to civil rights, particularly such aspects of those rights as liability reach far back into history. In regard to the rights of Blacks, in fact, they reach all the way to the post Civil War years. With the end of the Civil War our nation, not yet one-hundred years old, was faced with picking up the pieces and moving on. Although the northern states had escaped the war relatively unscathed, and in fact had prospered as a result of it, the South has sustained tremendous damage both materially and ideologically. It was up to the government to reclaim what was reclaimable and to rebuild what was completely devastated. The way to accomplish this reconstruction, however, became quite controversial, particularly in regard with how to deal with the freed slaves in a manner which would ensure their ability to survive in a world which would undoubtedly continue to harbor many innate prejudices. Decisions were consequently made which at least partially protected the rights of the newly freed slaves but which would have resounding implications for years to come. One of these implications is the liability crisis which our businesses, governments, and organizations are facing today when they try to hire or replace employees based on qualifications rather than racial, ethnic, or gender identity. The Emancipation Proclamation had freed African Americans from the bonds of slavery but it did nothing toward meeting their basic needs. Blacks had grown accustomed to being cared for by their owners much in the same way livestock was cared for, consequently they even lacked the experience to care for their most basic of needs.
