People want to see justice done, but the kind of justice they want does not always coincide with the law. It seems as if the laws on the books have a great deal of loopholes. As pedophiles roam the streets, and are only required to register with the police department near their residences, they are still free to hurt children. Many people find this unconscionable. There is no law on the books to deem a mandatory minimum for a sex offender, even though they are the most heinous criminals in society. In fact, once they are thrown in prison, it is often the case that they are harmed by the inmates because even there, pedophiles are disliked. Interestingly, while the law does not embrace mandatory minimums or something of that nature for the very violent and egregious offenders, mandatory minimums are often available for drug related criminals. Mandatory minimums and three strikes laws make it impossible to use discretion. This trend began during the middle of the 1970s when state legislatures started to replace the idea of indeterminate sentencing with determinate sentencing principles (Bohm, 2006). The question is, if these sentencing guidelines are acceptable for drug users, why are child molesters not treated the same way? The question is not easy to answer, but much goes to the political climate. There is a drug problem in America and there is a war against drugs. Hence, the concept of drugs--DARE programs, house rules for teens, marijuana protests, "head shops"-are quiet obvious. At the same time, pedophiles look like average people and they are only discovered rarely and when something horrible has occurred. People simply do not give as much attention ...
