In this speech, Daniels identified the foremost challenge facing American criminal justice organizations as terrorism. She stated that "The terrorist attacks on America have results in a number of new realities for criminal justice in this country," which have served to create a situation wherein both state and local agencies "have to do more with less" (Daniels). This is due to the loss of employees who are called to active military duty, as well as due to the increased responsibilities on the part of police and prosecutors who now have to handle aspects of crime investigation that have traditionally been in the domain of federal law enforcement (Daniels). An increase in cases has, in turn, resulted in a greater workload for the courts. However, despite the focus on terrorism, the Department of Justice is also faced with the typical challenges of law enforcement. Daniels assured her listeners that the Justice Department has become engaged in an "unprecedented collaboration with several other agencies of the federal government, to deal with the challenges posed to communities by the release from prison of violent and other serious offenders (Daniels). However, in facing the challenges of terrorism, crime and recidivism, another challenge for the criminal justice system is that the inherent liberties that are guaranteed to Americans in the Constitution are not lost in the process of addressing this problem. Commentator Michael E. Tigar accuses the Patriot Act, "and its kindred laws," of reviving the ethos of conspiracy laws that have been used in the past to suppress "labor unions, socialist parties and civil rights organizations" (Tigar 24). By broadening the scope of criminal law, the government has greatly expanded the "permissible scope of searches to uncover evidence of the crimes that they have now created" (Tigar 24). This is ...
