The onus is therefore on the nurse or physician to familiarise themselves with the areas in which they are personally accountable in the course of their working life. Health care workers are accountable as professionals, to their employers under employment legislation, and also under the same civil and criminal laws which apply to all citizens of the country. Whyte and Gajos found in their study that although nurses were aware of the existence of accountability, there was some confusion as to how far accountability extended and where their specific responsibilities lay. Some thought, for example, that they were only accountable in a professional sense and could not be called to account by either their employers or by the judicial system. Professional accountability is concerned with the health care workers duty to abide by the code of practice which is set out by the relevant professional body, and which delineates the ethical code and the parameters of responsibility which they are expected to abide by. Accountability to ones employer is, as in the case of any other worker, set out by the employment laws of the country concerned and is paralleled by the employers duty towards the worker. Legal accountability is that which is delineated by the civil and criminal laws of the country, and the health care worker is bound by the same prescriptions as any other citizen. In some cases, a particular course of action may be challenged in all four arenas, in that it is professionally unethical, contravenes employment law, and is a criminal act which could also be liable for compensation claims in the civil courts.
