That system revolves around two primary players when it comes to criminal sentencing. These players are the judge that presides over the case and the jury that is assigned to weigh out the evidence. Not all criminal cases, however, go before a jury. Many go before a judge alone. This is true despite the fact that there has been a movement in recent years advocating that community and neighborhood boards or panels are a more appropriate sentencing mechanism. Some even contend that judges are anachronistic, that they should be replaced with community boards and panels. This paper, however, will argue that our system is best left unchanged. Both juries and judges have their place in American criminal justice. There are distinct differences between judges and those that comprise juries or even the neighborhood boards and panels that some recommend as a replacement for the trial judge. Judges are trained to do what they do. They go through years of schools and work in the legal profession before they ever don the black robe and take their seat behind the courtroom podium.
