In a case involving a union that represents steamship clerks, a membership policy was adopted which required that prospective members be sponsored by existing members ("Analyzing," 2004). In the case at hand, it turns out that thirty white members were admitted but no African Americans went on board (2004). Hispanics were not joining either (2004). The EEOC would file a lawsuit to go against the union as it claims that the union did discriminate against certain races and ethnicities and violates Title VII (2004). It was on appeal that the court found the unions policy was not lawful as it was equivalent to a disparate impact on the African American community as well as on the Hispanic community ("Analyzing," 2004). Other facts of the case demonstrate that these groups did constitute a good number of workers who were a part of the local labor force (2004). In other words, it is not a situation where African Americans and Hispanics were simply not available. In any event, the union argued that the claim is irrelevant because minority applicants never sought membership (2004). The court rejected the argument (2004). It is alleged that the district court confused racial discrimination with nepotism (2004). Still, the court ordered the organization to change its admissions policies (2004).
