Should capital punishment be outlawed for those under the age of eighteen years, or should the situation be taken into account, such as the complexity or sophistication of the acts in question? In the DC sniper case, the boy was actually lucky that the prosecutor chose not to charge him with a capital crime. When Malvo was first caught, Lithwick (2002) wrote a piece contending that the U.S. is just one of seven countries that will execute juveniles and that the states in which most of Malvos homicides occurred are all death penalty states. This is of course one case and there are extenuating circumstances. Many referred to it as sort of a Svengali situation. It was also alleged that Malvo was essentially brainwashed by his stepfather, who was in fact his co-conspirator (Lithwick, 2002). The situation does bring to the forefront ideas about capital punishment and whether or not seventeen year olds should be executed. During the year that Malvo committed the crime, the United States Supreme Court did look at their 1989 decision allowing states to execute defendants who were 16 or 17 years old when they committed their bad acts (Lithwick, 2002). But five justices would not look at the issue again, so the 1989 decision would stand (Lithwick, 2002). The issue is rather broad, which is why there is a case to be made for examining circumstances as opposed to age alone. In fact, many states will only allow the death penalty to be used under certain circumstances and they are called special circumstances.
