It has come a long ways from the simple amendment presented by the founding fathers of this country, but it is still a basic right of protection that is perhaps needed more now than at any other time in history. This is because the country is so diverse and complex that people need to know they still have the right to fight for their own personal freedoms in a government that seems to creep further and further into personal lives. In the following paper we examine the amendment, its history and important cases or events relating to the amendment. History and Definition The Fifth Amendment is as follows: "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb, nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use without just compensation."1 This particular amendment was written in order to protect people, people who are accused, from abuses that are not uncommon in history.
