In this paper, well go into detail about federal legislation (the American with Disabilities Act specifically) and also discuss how the state of Maryland supports protection for the disabled. An Explanation of Disability Law Before we go into specifics about disabilities, the state of Maryland and the differences between physical and psychological disabilities, lets first examine the Americans with Disabilities Act (ADA) of 1990. The act basically prohibits any type of discrimination against people when it comes to employment, housing, education and access to public services (Legal Information Institute, 2004). Furthermore, the ADA defines "disability" as 1) a physical or mental impairment that limits one or more "major life activities" of the person in question; 2) a "record" of this particular impairment or 3) considered to have the impairment (Legal Information Institute, 2004). In addition to prohibiting discrimination, the act notes that "reasonable accommodations" must be made to provide disable individuals with equal opportunities (Legal Information Institute, 2004). The Equal Employment Opportunity Commission (EEOC) and the Department of Justice, as well as state agencies, are charged with maintaining and enforcing the act (Legal Information Institute, 2004).
