captured in the book, Mr. Polks Army by Richard Bruce Winder. In his book he uses actual primary accounts from the time of the Mexican-American War. Through these accounts one is able to see if the army really belongs to Mr. Polk, or if the army belongs to something larger. In May of 1846 President Polk found himself in a terrible predicament. The War of 1812 had made it evident that the United States military structure was unsound. This spurred on the development of the militia formed in each state. Thinking that this would serve for the next campaign Polk neglected to consider, at the onset of the Mexican- American War, that many of those who had formerly served in the War of 1812 were now too old for active duty. Where would he get the men to fill the positions that needed to be filled? The laws governing the use of the states militia were quite clear on the matter. The states militia could only be used to execute the laws of the United States, to suppress insurrections, and to repel invasions(Polk 25). In addition, the way the charter worked, militia could only be activated for 90 days at a time. The problem with that was that much of that time was spent training them. By the time the training was completed, there was little time left to use the militia on an actual campaign of any sort. In short, President Polk was in trouble if he wanted to wage a war with Mexico. Polk created a new system of militia called the volunteers.
