The 2000 presidential election in the United States was the most controversial in history. The selection of the new president was delayed due to problems with the voting process and the machine count of votes in the state of Florida. The case was heard before the Florida Supreme Court. This court ruled that 170,000 votes should be recounted by hand because the machines used to tally the votes had rejected these ballots. Bush lawyers then filed a petition with the United States Supreme Court to stop the manual count of these votes. In what became an infamous decision, the U.S. Supreme Court ruled there were constitutional problems with the Floridas Court order to hand-count the votes. In a 7-2 "per curiam" opinion the U.S. Supreme Court ruled that the manual count of votes had to stop (Chebium, 2000). The opinion stated that the manual recounts of the votes should be stopped because they are unconstitutional and cannot be completed by the deadline mandated by federal law. "That date is upon us, and there is no recount procedure in place under the state Supreme Courts orders that comports with minimal constitutional standards. Because it is evident that any recount seeking to meet the December 12 date will be unconstitutional ... we reverse the judgment of the Supreme Court of Florida ordering a recount to proceed. . . . The variations in the ballots and the lack of a uniform, statewide standard spelling out how the ballots should be counted, and by whom, means recounts are unconstitutional under the 14th ...
