This is the case not just for the criminal justice process as it applies to jury trials, however, but also to the development of the instrument of law which underwrites the justice process and serves as its foundation. The development and perpetuation of laws and corresponding punishments is carried out by a tripartite cooperative approach between all three branches of government: legislative, executive, and judicial. This paragraph helps the student introduce the topic of drug legislation. In order to better understand how this is the case, it can be useful to look at one specific example of law enacted and perpetuated by all three levels of government: drug laws. The "war on drugs" continues to be a controversial topic in the United States, and is often cited as a critical waste of resources. To be sure, the United States does house a number of prisoners disproportionately high in comparison to its population, and the majority of these offenders are in prison for violating drug laws. However, supporters of the war on drugs claim this expenditure is necessary in order to maintain social order. Whether or not one believes that the recreational use of marijuana is evidentially correlated with the descent of the state into total anarchy, drug laws are so pervasive as to be supported by all three governmental branches. The legislative branch of government is that which is directly involved in the democratic formation of laws. One key example of the legislative branch impacted drug laws is through the passing of key pieces of legislation such as the Controlled Substance Act.
