The defendant kidnapped a woman seeking only to do a good deed in giving someone a ride on a cold day. The defendants response to this womans generous gesture was to kidnap her, physically assault her, steal her car and then proceed to use that car to kill two innocent people. Shortly after entering the womans car, the defendant pulled a gun on her, eventually striking her with it and pushing her from her own car. He then drove irresponsibly and killed a child who ran into the road. The next day he rocketed through a school zone at 70 mph to kill a crossing guard present to protect children who also were present at the time. Part B Felony Murder. One of the deaths was accidental in the sense that a child ran out in front of the care Paul was driving and Paul could not avoid hitting the child. The childs death was not accidental in the sense that Paul was driving a stolen car and should not have been present on the road at the time that the child ran out into it. The definition of felony murder is that it is a killing that is unintentional, occurring "during the commission or attempted commission of another serious felony" (Lecture Notes, p. 5). This timing and therefore the type of death may be debatable, depending on whether Paul had left the vehicle after kidnapping and pushing out its owner.
