perspectives. Conflict Perspective The "Conflict Perspective" operates from the vantage that the "law is heavily influenced by the concept of power" (Lecture Notes, 2005; p. 4). Conflict theory maintains that "there are different classes in society which involve power struggle. Those who are dominant in this class struggle are generally those in power, in legislative and enforcer positions" (Lecture Notes 6, 1999). Those who are dominant are also those responsible for creating the laws that reflect their perspective, and they have the power to direct the framework in which their laws are enforced. Thus those dominant in the society occupy a position in which they are able to dictate what the laws will be, how they will be enforced and often how severe the penalty for violation of those laws will be. "This language suggest[s] that truth depends on how much power you are enabled to wield" (Lecture Notes 6, 1999). Examples can be found in the United States and in other countries of the world. The "Jim Crow" laws of the past serve as example of laws originating in the conflict perspective. Jim Crow described the "separate but equal" doctrine established in Plessy v Ferguson in 1896 that kept the black and white races legally separate for 70 years. The apartheid era of South Africas history also provides an example of this perspective. Though Jim Crow laws generally did not forbid the intermingling of blacks and whites in America in public places, they did result in indignities such as the whites-only restaurants, where black people were good enough to wash the dishes but were not good enough to be seen by ...
